Terms and Conditions for Portrait Commissions

Welcome to SRS Creative. This website, located at www.srscreative.art is owned and operated by Seres Creative SRL, reg. no. 35586698, J1/121/04.02.2016, doing business as “SRS Creative” and “Seres Zoltan Artwork”. Our registered business address is at 296 Morii St, Unirea, Alba co, Romania. 

By accessing or using this website and our services, including commissioning portraits, you agree to comply with and be bound by the following Terms and Conditions.

These terms govern your access to and use of the website, any content, functionality, and services offered on or through the website, including but not limited to portrait commissions.

Definitions

Artist – Seres Creative SRL, the individual or entity providing Portrait Commission services. 

Website – srscreative.art which is the property of Seres Creative SRL, used for Portrait Commissions. 

Customer – the individual or entity commissioning the artwork or purchasing from the Artist.

Electronic Contract for the Portrait Commission – written agreement specifying the details of the Portrait Commission.

Portrait commission – custom artwork created by the Artist at the request of the Customer. 

Commission Process

1. Initial Consultation

Communication is done via phone, email, Whatsapp or social media. Customers will provide a detailed description or reference images for the portrait. A discussion regarding size, medium (e.g., oil, pencil), and any specific requests will take place. An electronic contract for the Portrait Commission is sent via email or whatsapp to the Customer regarding the Portrait Commission details, Customer name, address, Artist name, address, price and GDPR.

2. Pricing Structure:

Pricing is based on paper size and the number of people in the portrait and can be found on srscreative.art. Also, there are extra fees, like shipping (for orders below RON 500 or EUR 100), framing and urgency tax. Price is communicated to the Customer by the Artist at the initial consultation phase and it will be specified in the Electronic Contract of the Portrait Commission. 

A 30% non-refundable deposit is required to secure your booking for a Portrait Commission bigger than RON 1000 or EUR 200.

3. Creation Process

Progress updates will be provided at agreed stages. A high-resolution photo will be sent to the Customer via email or WhatsApp to see the result. Customers can request minor adjustments during the creation process. Major changes may incur additional costs.

4. Delivery

The balance is due upon completion of the portrait for international Customers. The final artwork will be delivered only after the full payment is received. Romanian Customers can opt to pay at shipment pickup (cash on delivery). 

Delivery times will be estimated during the initial consultation. Delays may occur due to unforeseen circumstances. Portraits will be shipped via Prioripost (Romanian Customers) and via DHL (international Customers). Shipping is free for portrait commission bigger than RON 500 or EUR 100.

Deadlines, Extensions and Delays:

Deadlines are discussed at the initial discussion phase. Usually a Portrait Commission is done in a week but during peak times it may require more time to finish a Portrait Commission. There is an urgency tax, which the Customer can opt for. This means the Artist will be working on the Portrait Commission during extra time (evenings, nights, weekends or holidays) in order to finish in time. Shipping is usually 1-2 workdays for Romania and about 3-8 days for international shipping.

If unforeseen circumstances arise that may delay the Portrait Commission, the Artist will notify the Customer as soon as possible to discuss a new deadline. 

Extensions may also be granted if both parties agree to the revised timeline.

Payment methods

Payments can be made via PayPal, bank transfer for international orders and bank transfer or cash (pay when receiving the portrait or personal pick-up) for Romanian Customers. All prices are in RON for Romania and EUR for international buyers and include any applicable taxes.

Cancellation and Refund Policy

The 30% deposit is non-refundable once the commission is agreed upon and work has begun. If a Customer cancels the commission after work has started, they are not required to pay for the work completed beyond the deposit. 

Return Period: Clients have the right to return any purchased items, excluding custom Portrait Commissions, within 14 days of receipt.

Return Conditions: Items must be returned in their original condition and packaging. The Client is responsible for return shipping costs.

Refunds: Refunds will be issued within 14 days of receiving the returned item. The original shipping cost is non-refundable.

Intellectual Property Rights

The commissioned portrait is for personal use only. Customers may not reproduce, distribute, or use the artwork for commercial purposes without explicit permission. Seres Creative SRL retains all rights to the artwork, including the right to use images of the artwork for promotional purposes.

Customer Responsibilities

Customer must provide clear and accurate information and reference materials (reference photos) for the portrait commission and for legal purposes (Electronic Contract for the Portrait Commission, invoicing). Timely communication is essential to ensure the Portrait Commission progresses smoothly.

Satisfaction Guarantee

We strive for complete Customer satisfaction. If there are issues with the final product, we will discuss reasonable solutions.

Limitation of Liability

Seres Creative SRL is not responsible for any damages or losses incurred during the shipping process. In no event shall Seres Creative SRL be liable for any indirect, incidental, or consequential damages arising out of or in connection with the Portrait Commission.

Events outside of our control (Force Majeure)

None of the parties will be responsible for non-performance of its contractual obligations, if such non-performance is due to a force majeure event. Force majeure is the unforeseeable event, beyond the control of the parties and which cannot be avoided.

Applicable law – jurisdiction

This contract is subject to Romanian law. Any disputes arising between the Artist and the Customer will be resolved amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts.

Confidentiality and Privacy

Customer information will be kept confidential and used solely for the purpose of completing the commission and delivering the Portrait Commission, in accordance with GDPR.

By commissioning a portrait from Seres Creative SRL, the Customer acknowledges that they have read, understood, and agreed to these terms and conditions.
